Can You Sell a House As-Is in Illinois? What You Still Have to Disclose
Yes, you can sell a home as-is in Illinois. But "as-is" does not mean "no questions asked." Even if you will not make a single repair, Illinois law still requires you to tell buyers about certain known problems. If you are selling in Naperville, Aurora, Oswego, or Plainfield, Illinois, here is what as-is really covers, what it does not, and how to decide if it is right for you. We are Realtors, not attorneys, so ask your attorney about your own situation.
What "As-Is" Means
Selling as-is means you tell the buyer you will not make repairs or give credits for issues found. The buyer can still do inspections. They can still walk away during the inspection period if they do not like what they find, depending on the contract.
So as-is changes who pays for repairs. It does not take away the buyer's right to inspect.
What As-Is Does Not Do
Here is the part that surprises sellers. Illinois has a Residential Real Property Disclosure Act, and as-is does not cancel it. Most sellers of homes with one to four units must give buyers a disclosure report about known issues, like water in the basement, roof leaks, and other defects. We broke this down in our post on what sellers must disclose in Illinois. For general consumer information, see the Illinois Attorney General's homeowner resources.
The simple rule: if you know about a problem, write it down. Hiding a known problem can lead to a lawsuit, and as-is will not protect you.

When Selling As-Is Makes Sense
You are selling an inherited home. Heirs often do not want to fix up a home they never lived in. We wrote about this in our guide to selling an inherited house.
The repair list is long. If the work costs more than you will get back, as-is may keep things simple.
You need speed. Skipping repairs can save weeks.
You are moving for work or have a tight timeline.
You do not have the money to fix things up front.
When It Does Not
Your home is in good shape. Small fixes can pay off. Fresh paint and clean landscaping often cost far less than the price drop buyers will ask for.
Buyers are using loans with condition rules. Some loans require certain repairs, even if you say as-is. That can make deals fall through late.
Rates are high. With the 30-year fixed rate at 7.28% on Freddie Mac's October 1 survey, buyers are watching every dollar. Many ask for credits when they see problems.
How to Sell As-Is the Smart Way
Price it honestly. An as-is home priced like a perfect home will sit. See our post on how to price your home in the western suburbs.
Consider a pre-listing inspection. Knowing what a buyer will find helps you price and avoid surprises.
Fill out your disclosure fully and honestly.
Fix cheap things that scare buyers. A bad first impression can cost more than the repair.
Know your net. Add up your costs in our guide to closing costs in Illinois. Your bottom line is what counts.
Ask about the buyer's financing. A cash buyer or a buyer with strong financing is often a better fit for an as-is deal.
Not sure who to ask about your disclosure? We recommend James F. White or Andrew Heap of Kuhn Heap. Tell them Team Elite sent you so they know to take great care of you.

Frequently Asked Questions
Can I sell my house as-is in Illinois? Yes. You can sell as-is, but you still must complete the required disclosure for known issues. Ask your attorney if your sale is covered (we recommend James F. White or Andrew Heap).
Do I have to fix things the inspector finds if I sell as-is? Usually not. But the buyer may cancel during the inspection period or ask for a lower price.
Does selling as-is mean I get a lower price? Often buyers expect one, because they take on the repair cost. A realistic price and good presentation help.
